May I introduce myself as one of the top VAT & Property specialists in the UK. I am a Member of the Council of The Institute of Indirect Taxation and am an active Member of the British Property Federation VAT Committee currently representing them on two important discussion groups with members of the Customs & Excise VAT Policy Directorate:

My clients range within the field of property companies, off shore companies and firms of lawyers and accountants, I also help to advise other VAT Practitioners within the property field.

Being an active Member of the BPF VAT Committee I have been representing them on two important discussion groups:

1.


The VAT Land & Property Liaison Group (Still in progress)

This Group was set up to by David Ogilvie of the VAT Policy Directorate (VPD) and is now run by Robin Caley to review and refine much of the legislation in Schedule 10 of the 1994 VAT Act and is thus highly focused on the option to tax.

Partial Exemption Review (Now concluded)

This Committee was headed by Mike Cunningham and Jon Cannon of the VPD and examined the changes which were required to the existing partial exemption methods used by the property industry. The Committee recognised that there was no strict policy within Customs & Excise towards partial exemption methods and the criteria which should be applied, nor were there any concise definitions to the terms that were being used within the 1995 VAT Regulations. The Committee, therefore, produced a “Glossary of Terms” which now forms a basis for Officers to construct concise formulas for partial exemption methods in the property industry. This ground work will then move forward and will embrace all industry throughout the UK.

During the thirteen years that I have served the BPF VAT Committee I have attended several Liaison Group Brain Storming Meetings hosted by Stewart Kingaby as Chairman and David Ogilvie. As aforementioned, now currently Robin Caley representing The Land and Property Branch at King’s Beam House dealing with many subjects with regard to Schedule 10, VATA 1994. I have also chaired a meeting with Sebastian Hordern from The National Audit Office dealing with Customs and the Value For Money Report for large traders.

In addition:
I participated on a brain storming team as part of the Arthur Anderson review (Harmonising VAT on property within the EU) on behalf of the European Commission of the way VAT is applied to the property sector throughout the EU.

I was involved in the lengthy discussions with Customs which followed the introduction of Section 37 of the 1997 Finance Bill. As you will be aware those discussions went to amend the wording of the Bill and resulted in a much less draconian form of legislation with regard to Avoidance and which was later incorporated into the 1997 Finance Act. I still am involved in the way forward with regard to this area of legislation.

I have in the past given many lectures on VAT and Property to property companies, firms of lawyers and The Institute of Indirect Taxation. I am also a regular writer for the Institute of Indirect Taxation’s “Tax Voice”.

My intention is to continue developing my Consultancy and I am not adverse to taking on lengthy projects.

I continuously update my Web Site on the Internet to accord with legislative changes and changes in Customs’ practice and as a matter of importance it contains a News Update Page.. This Site is very extensive and is designed to make those who subscribe aware of the pit falls in the aforementioned areas. I have developed this site as I note there is little to be offered on the Internet by any other writers and I feel that it will be an important aid to those involved in the more complex VAT issues.

MEPC Limited/ Former plc I act as the MEPC Group’s VAT Consultant and have provided this service to the Group for more than twenty years. I have recently been involved in developing a new VAT computerised system for MEPC. The system is extremely flexible and is designed to cope with all possible changes within the business functionality of a property company.
